With that....the defendants need to answer the questionnaire presented to them. If they are not driving issues prior to the flash memory in the same manner....they should answer/show accordingly and be dismissed from the case.

Seems simple enough, they know what they do and what e.Digital does...if one does not want to be involved, spell it out and be gone if you do it differently.

There are no big secrets here.

If they do not answer or supply the info.....only one thing can be derived from that, where I hope that stand off action is considered by the court. This is the only spot where I might be getting ahead of my considerations...with RE: "we're done"....It may take DM to have to force the issue in this regard in phase two of discovery to really get to the meat of it all.
